If someone purchases auto insurance hours after a wreck will it cover them?

i was driving down the road and someones tire came off there car and hit my car.. it appears that they did not have insurance at the time but purchased it hours after the accident, because the driver stated that he had isurance the police allowed him to bring proof to the courthouse. no tickets or anything. well his proof shows he has coverage because he bought it that same day, the insurance co, says they will not cover my car because it was purchased after the wreck. is this legal?

Best Answer – Chosen by Voters Yes, his insurers dont owe you anything. If insurance was retroactive nobody would get it, they would just wait to have a crash!Btw it isn't illegal to buy insurance after having a crash, what's illegal is driving without insurance which is a different thing.Your course of action would be to get a lawyer and sue the person, maybe your own insurers might be able to help if you have bought legal coverage. You can't purchase insurance and make if effective retroactively. Otherwise nobody would carry insurance and only would buy it after they had an accident. The other driver had no insurance in force at the time of the collision, therefore they can deny your claim. You need to make a claim to your insurance company and get your vehicle fixed, and they will deal with the other driver.

Yes it's legal. You can't purchase auto insurance after an accident happened and expect them to pay. He will have to pay you out of pocket for your damages, either voluntarily or after you sue him. After he pays you he could then sue his insurance company (and will lose) but that needn't concern you.

The other drive has committed fraud and the police should be charging him. He is personally responsible for any damage to your car so you can sue him.Are the police aware of his fraud. If not, let them know.Ensure your own insurance is aware of the circumstances. You may need to claim against them.You may need legal advice.

legal yes but it should just limit the"no insurance" ticket but you will need to get a lawyer and along with your insurance company get your ride fixed.

What the guy did was illegal and never allowed. To recover, you will have to file a claim through your own insurance company. They will "go after" the bad guy on your behalf.

It can't cover them after the incident! that would be like setting fire to your house and then buying insurance against fire, you need to speak to a Professional about this.
